SACRAMENTO—United States Attorney McGregor W. Scott announced today that DAVID KEARBY CLEMENTS, 50, of South Lake Tahoe, California, was sentenced this morning by United States District Court Judge Frank C. Damrell, Jr. to five years in federal prison for receiving and possessing child pornography.

This case was investigated by the Federal Bureau of Investigation, the South Lake Tahoe Police Department, and the California Highway Patrol.

According to Assistant United States Attorney Michelle Rodriguez, who prosecuted this case, CLEMENTS possessed over 65 images of child sexual abuse. As part of his sentence, CLEMENTS was ordered to forfeit all of the computer equipment that he used to receive and possess sexually explicit images of minor females. After completion of his five-year prison term, CLEMENTS will be on federal supervised release for eight years and required to register as a sex offender for the rest of his life. He was also ordered to pay a statutory special assessment of $500.

The prosecution of CLEMENTS is part of “Operation Valley Predator,” a three-day multi-agency operation spearheaded by the Sacramento Office of the FBI and the U.S. Attorney’s Office for the Eastern District of California as part of Project Safe Childhood (PSC), a national initiative of the U.S. Department of Justice, designed to increase federal and state prosecutions of violent sexual predators of children. As a part of Project Safe Childhood, the United States Attorney’s Office in both Sacramento and Fresno has teamed with state and local agencies throughout the Eastern District to enhance law enforcement presence on the Internet and to educate the public about safe Internet use. For additional information on the PSC initiative, please go to www.projectsafechildhood.gov, or call the United States Attorney’s Office for the Eastern District of California and ask to speak with the PSC coordinator.
